The Champaign County Regional Planning Commission (“CCRPC”) in affiliation with the Illinois Department of Transportation (“IDOT”) makes the BikeMoves Illinois mobile application (“BikeMoves”) available to you under these terms and conditions (“Terms”). By using BikeMoves, you agree to these terms and conditions. This is a legally binding contract; if you disagree with any provisions in this document, you are not permitted to use BikeMoves.
1.1 Use of Service
You must be at least thirteen (13) years of age to use BikeMoves. In order to use BikeMoves, you must have a compatible device. BikeMoves is compatible with Android and iOS devices.
BikeMoves will be modified frequently and updates will be sent to your device that may change appearance and functionality. These updates include modifications, upgrades, bug fixes, patches and other corrections and/or new features. If you choose to not install updates, BikeMoves may not operate properly. If you chose to install Updates, you agree that the Terms (and any modifications) will apply to any and all updates to BikeMoves.
1.2 Ownership and Use of Content
BikeMoves allows you to record and submit bicycle trips and rider demographics. Once submitted, these data become the property of CCRPC and IDOT. CCRPC and IDOT use trip data and rider demographics submitted via BikeMoves for planning purposes and may share de-identified data with partner agencies. In Addition, aggregated trip data and demographics may be shared with the public. For Details of how CCRPC and IDOT use and share data submitted via BikeMoves, see the BikeMoves Privacy Policy.
1.3 Limitation of Liability
To the extent permitted by law, CCRPC and IDOT are not liable for loss or damages incurred while using BikeMoves. You are responsible for obeying the rules of the road and all applicable traffic laws while using BikeMoves.
BikeMoves is designed to be controlled at the start and end of your bicycle trip and to run passively on your device while you are in motion. DO NOT attempt to control BikeMoves while your bicycle is in motion or while you are in the path of traffic.
1.4 Governing Law
These Terms are governed in accordance with the laws of the State of Illinois.
1.5 Miscellaneous
Any provision not mentioned in the Terms does not waive the right for CCRPC and IDOT to enforce such right. CCRPC and IDOT reserve the right to modify or change this document at any time.
